These Terms of Service ("Terms") govern your use of ForgeFlow, operated by Novus Enterprises AG (Aktiengesellschaft, registered in Liechtenstein), including the website at forge-flow.app, the browser extension, and all related services (the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

ForgeFlow provides AI-powered real-time translation, voice message generation, and chat assistance tools for OnlyFans agencies. The Service includes:

• A browser extension that translates chat messages on onlyfans.com
• AI-generated reply suggestions
• Voice message generation via text-to-speech
• A web dashboard for managing models, settings, and subscriptions

2. Eligibility

• You must be at least 18 years old to use the Service.
• You must have the legal authority to agree to these Terms on behalf of yourself or your organization.
• You must comply with OnlyFans' Terms of Service while using our extension on their platform.

3. Account & License Keys

• Each account is for a single organization. Account sharing is not permitted.
• License keys are generated for individual chatters and are non-transferable.
• You are responsible for keeping your login credentials and license keys confidential.
• You must not share, sell, or distribute license keys to unauthorized parties.
• We may deactivate license keys or accounts that violate these Terms without prior notice.

4. Subscriptions & Payments

4.1 Plans & Billing

• The Service is offered as a paid subscription with multiple plan tiers.
• Prices are listed on our pricing page and may change with 30 days' notice.
• Subscriptions are billed monthly or annually, depending on your chosen plan.
• All payments are processed securely through a PCI-certified payment processor.

4.2 Free Trial

• New subscribers may receive a free trial period as indicated during checkout.
• If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

4.3 Refund Policy

• We offer a 30-day money-back guarantee for first-time subscribers.
• Refund requests must be sent to support@forge-flow.app within 30 days of the initial purchase.
• Refunds are not available for renewal payments, plan upgrades, or after the 30-day period.

4.4 Cancellation

• You may cancel your subscription at any time by contacting support@forge-flow.app.
• Cancellation takes effect at the end of the current billing period.
• No partial refunds are given for unused time within a billing period.

5. Usage Limits

• Each plan includes specific word and voice message limits as described on the pricing page.
• Exceeding your plan's limits may result in temporary service suspension until the next billing cycle or until you upgrade.
• We reserve the right to throttle or restrict usage that significantly exceeds normal patterns (e.g., automated bot usage).

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Attempt to bypass usage limits, authentication, or security measures
• Share, resell, or sublicense access to the Service without written permission
• Use the Service to harass, threaten, or impersonate others
• Transmit malware, viruses, or other harmful code through the Service
• Use automated tools (bots, scrapers) to interact with the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service involving minors in any capacity whatsoever
• Use the Service for fraud, scams, or to intentionally deceive third parties in a harmful manner
• Use the Service to generate content that violates any applicable content laws or regulations

You are solely responsible for all content you create, translate, send, or distribute through the Service. ForgeFlow is a tool - it does not monitor, review, or approve the content you generate or the messages you send on any platform. You must ensure that all content complies with applicable laws, platform rules, and the rights of third parties.

7. Intellectual Property

• The Service, including its code, design, prompts, and algorithms, is the intellectual property of Novus Enterprises AG.
• Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.
• You retain all rights to your own content (chat messages, glossary entries, etc.).
• We do not claim ownership of any content you create or translate through the Service.

8. Voice Cloning & Voice Messages

8.1 Voice Rights & Authorization (IMPORTANT)

The Service includes AI-powered voice cloning and text-to-speech features that generate synthetic voice messages. By uploading voice samples or activating the voice feature for any model, you represent, warrant, and confirm that:

• You are the legal rights holder of the voice being cloned, OR you have obtained explicit, documented, written consent from the voice owner (the model/creator) to create and use an AI clone of their voice.
• The voice owner has been fully informed that their voice will be used to generate synthetic audio messages that will be sent to fans on OnlyFans on their behalf.
• The voice owner has not revoked their consent and you will immediately cease using the voice clone if consent is withdrawn.
• You have the contractual authority (e.g., management agreement, agency contract, or equivalent) to act on behalf of the voice owner for this purpose.
• The voice samples you upload are genuine recordings of the consenting person and not recordings of third parties, public figures, or any person who has not given consent.

8.2 Your Obligations

You agree to:

• Maintain records of voice consent (written agreement, email confirmation, or equivalent documentation) for the duration of your use of the voice feature and for 2 years thereafter.
• Provide proof of consent to Novus Enterprises AG within 48 hours upon request.
• Immediately notify us if consent is revoked by the voice owner, so we can delete the voice clone.
• Not use voice clones to impersonate individuals without their knowledge, create misleading content, or for any purpose outside of OnlyFans chat communication on behalf of the consenting model.

8.3 Liability for Voice Misuse

Novus Enterprises AG acts solely as a technology provider. We provide the tools to create and use voice clones but we do NOT verify the identity of voice owners or the validity of consent. The responsibility for obtaining and maintaining proper voice rights lies entirely with you (the account holder/agency).

• You are solely liable for any claims, damages, or legal actions arising from unauthorized use of someone's voice.
• If we receive a complaint or legal request regarding a voice clone on your account, we will immediately disable the voice clone and may suspend your account pending investigation.
• Violation of voice rights may constitute a criminal offense in many jurisdictions (including identity fraud, personality rights violations, and copyright infringement). You accept all legal responsibility.

8.4 Voice Data Handling

• Voice samples are uploaded to our secure storage and sent to our voice synthesis provider for model creation.
• Voice clones are stored as private models and are not shared publicly.
• Upon account deletion or voice consent revocation, voice clones and associated audio samples will be deleted within 30 days.
• You may request deletion of a voice clone at any time by contacting support@forge-flow.app.

9. AI-Generated Content (Translations & Suggestions)

• The Service uses AI (artificial intelligence) to generate translations, reply suggestions, and sales prompts.
• AI-generated content may not always be perfectly accurate. You are responsible for reviewing all translations and suggestions before sending them to fans.
• We are not liable for any consequences arising from inaccurate translations, inappropriate suggestions, or AI-generated content, including but not limited to lost revenue, account suspensions, or fan complaints.
• AI suggestions (reply suggestions, PPV prompts) are provided as recommendations only. You are not required to use them and should exercise your own judgment.
• By using AI-generated translations or suggestions, you accept full responsibility for the resulting messages. ForgeFlow acts solely as a translation and assistance tool. The decision to send, modify, or discard any AI-generated content is entirely yours.
• ForgeFlow does not guarantee that AI-generated content will be appropriate, culturally sensitive, or free of errors in any language combination.

10. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you also agree to the Privacy Policy.

11. Service Availability

• We aim to provide 99.9% uptime but do not guarantee uninterrupted service.
• The Service depends on third-party providers that we do not control.
• We are not liable for downtime caused by third-party outages, OnlyFans platform changes, or force majeure events.
• We may perform maintenance that temporarily affects availability, with reasonable notice when possible.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that translations will be 100% accurate, that voice clones will perfectly replicate any voice, or that the Service will be error-free, uninterrupted, or secure.
• Our total aggregate liability for any and all claims related to the Service shall not exceed the amount you actually paid us in the 3 months preceding the event giving rise to the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost business opportunities, reputational damage, or loss of data, even if we have been advised of the possibility of such damages.
• We are not liable for any actions taken by third-party platforms (including OnlyFans) against your account as a result of content generated through our Service.
• We are not liable for any consequences arising from your reliance on AI-generated translations, suggestions, or voice messages.

12a. Third-Party Platforms

The Service is designed to operate on third-party platforms, primarily OnlyFans. You acknowledge and agree that:

• We are not affiliated with, endorsed by, or partnered with OnlyFans or any other third-party platform.
• Third-party platforms may change their terms of service, APIs, or functionality at any time without notice, which may affect the Service.
• We are not responsible for platform changes that render any part of the Service temporarily or permanently unavailable.
• You are solely responsible for ensuring your use of the Service complies with the terms of any third-party platform you use it on.
• We are not liable for any account restrictions, bans, or penalties imposed by third-party platforms.

13. Indemnification

You agree to indemnify, defend, and hold harmless Novus Enterprises AG, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of the Service or any content generated, translated, or distributed through the Service
• Your violation of these Terms or any applicable laws, regulations, or third-party rights
• Your use of the voice cloning feature, including but not limited to claims by voice owners, rights holders, or any third party alleging unauthorized use of their voice or likeness
• Any claim that you did not obtain proper consent for voice cloning
• Any claim by a fan, consumer, platform, or third party related to messages or content you sent using the Service
• Any action taken against you by third-party platforms (including OnlyFans) in connection with your use of the Service
• Your failure to review AI-generated content before sending it to recipients

This indemnification obligation survives termination of your account and these Terms.

14. Termination

• You may stop using the Service and close your account at any time.
• We may suspend or terminate your account if you violate these Terms, with or without notice.
• Upon termination, your license keys will be deactivated and your access to the dashboard will be revoked.
• Sections 6, 7, 8, 9, 12, 12a, 13, and 15 survive termination.
• Voice clones will be deleted within 30 days of account termination.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Principality of Liechtenstein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Vaduz, Liechtenstein.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will be revised. For material changes, we will notify you via email or through the Service at least 14 days before the changes take effect. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
